Eligibility

Westgate Resorts $250 Gift Card Giveaway is only open to legal residents of the United States and is void where prohibited by law. Must be twenty-one (21) years of age or older as of the date of entry to be eligible to win. Employees of Westgate Resorts, Ltd. (the “Sponsor”), Central Florida Investments, Inc., or its respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or where not registered. This Giveaway does not discriminate against anyone based on race, sex, age, handicap, religion, national origin, or marital status.

Agreement to Rules

By participating in the Giveaway, you agree to be fully and unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the content. By entering this Giveaway and providing your information, you expressly agree to the following terms and conditions: By providing your name, address, telephone, or electronic mail address (collectively my "Contact Information") or otherwise using this Site, you consent to and request for us to contact you to discuss this offer and the services and products we provide. Providing your Contact Information and your use of our Site shall be construed as a business inquiry by you of Central Florida Investments, Inc. and Westgate Resorts, LTD (collectively "Westgate"), even though neither entity may be affiliated with, or responsible for, the content contained on this offer. Westgate is thereby authorized by you to make a return telephone call and text to you, and you agree that Westgate may contact you using an automated telephone dialing system, prerecorded message, or by electronic mail. You agree to hold Central Florida Investments, Inc., Westgate Resorts, LTD, and their related or affiliated companies harmless and hereby release and indemnify their agents and employees from any and all liability that may arise from providing your Contact Information or accessing any affiliated sites.

How to Enter

The Giveaway must be entered during each individual specialty event or show beginning on the first day of the applicable event and ending on the last day of that same show (“Giveaway Period”). Entrants may enter via QR code posted at the event or via tablets provided at giveaway booths set up at specialty events. Entrants must provide their personal information in all required fields on the entry form. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. One entry per person per show/event is permitted unless otherwise stated on the entry form. You may not use multiple email addresses, accounts, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.

Prize and Prize Conditions

One (1) winner will be selected for each individual show/event. The winner will receive one $250 gift card in theme with the event. The type of gift card may vary depending on the event theme. The specifics of the prize shall be solely determined by the Sponsor. Average retail value is two hundred fifty dollars ($250). Prize must be redeemed by the date specified by Sponsor and in accordance with the redemption instructions provided. No cash or other prize substitution permitted except at Sponsor’s sole discretion. The prize is nontransferable and cannot be combined with any other offer, promotion, or package. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. Winner is responsible for all incidentals, service charges, gratuities, personal expenses, and transportation. Any and all entrants participating in or using profanity, unsportsmanlike conduct, explicit or discriminatory language, and/or defamation of the Westgate brand or any and all others will be automatically disqualified at Sponsor’s sole and absolute discretion. Sponsor shall not be responsible for any lost, garbled, incomplete, and/or corrupted entries, and qualified entries shall be determined in Sponsor’s sole and absolute discretion. Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, photograph, statements and biographical information, voice, and address in all forms of media worldwide, in perpetuity, without limitation, notice or further compensation.

Odds

The odds of winning depend on the number of eligible entries received for each individual show/event.

Winner Selection and Notification

All shows and events scheduled during the week are eligible for the weekly giveaway. The Sponsor will select the winner within 72 hours after the conclusion of the final applicable weekly show or event, from all eligible entries received for that week. The winner will be notified using the contact information provided at the time of entry. If the selected winner cannot be contacted, is deemed ineligible, fails to claim the prize within 7 calendar days, or does not return a completed and signed declaration, an alternate winner may be selected and release (if required), prize may be forfeited, and an alternate winner may be selected at Sponsor’s sole and absolute discretion. The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Terms and Conditions

Prize is not redeemable for cash or other services. Prize may not be used in conjunction with any other offer, promotion, and/or certificate. All entrants must be twenty-one (21) years of age or older and a U.S. Resident to win. Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway if any fraud, virus, or other technical problem corrupts the administration, security, or proper delay of the Giveaway, as determined by Sponsor in its sole and absolute discretion. Sponsor also reserves the right to eliminate all entrants found to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these rules shall not constitute a waiver of that provision. Void where prohibited by law or not registered. Sponsor shall not be responsible for any lost, garbled, incomplete or corrupted entries, and qualified entries shall be determined solely in the discretion of Sponsor. Sponsor reserves the right to alter Giveaway terms, requirements, prize, and rules at its sole discretion.

Release and Limitations of Liability

The winner agrees to release and forever hold harmless Sponsor, its related and affiliated entities and their respective officers, directors, employees, members, affiliates and agents from and against any claim or cause of action whatsoever arising out of participation in the Giveaway or any claims arising from and against all losses, damages, liabilities, claims, actions, proceedings, or judgments arising out of or relating to entrant’s entry or participation or use or misuse of prizes. All entrants agree to release and forever hold harmless Sponsor, its related and affiliated entities and their respective officers, directors, employees, members, affiliates, and agents from and against any claim or cause of action whatsoever arising out of any technical or human error which may occur in the processing of submissions in the Giveaway. Sponsor is not to be held responsible for any act of God, and/or any other circumstances beyond its control.

Rights Granted by you

By entering this Giveaway you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Disputes

IMPORTANT NOTICE AFFECTING YOUR RIGHTS: THIS OFFER IS GOVERNED BY THE LAWS OF USA AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. Venue for any action arising hereunder shall exclusively lie in Orange County, Florida. In the event of any controversy between the parties, including but not limited to any claim, dispute, suit, demand, cross claim, counterclaim, or third party complaint (whether statutory, in tort or otherwise) arising out of or relating to this site and its Offers and the interpretation or validity of these Terms, including the validity, scope or applicability of this arbitration provision (also “Agreement”), shall be determined by binding arbitration. This arbitration provision is governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. § 1 et seq. and not by any state rule or statute governing arbitration. THE PARTIES AGREE THAT ARBITRATION SHALL BE HEARD BY A SINGLE ARBITRATOR. YOUR CLAIM WILL NOT BE BROUGHT IN COURT AND NEITHER A JUDGE NOR A JURY WILL HEAR YOUR CLAIM. YOU MAY ASSERT A CLAIM IN ARBITRATION ONLY ON AN INDIVIDUAL BASIS AND NOT IN ANY REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL OR CLASS, COLLECTIVE OR MASS ACTION. FURTHER, THE PARTIES AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OF MORE THAN ONE PERSON’S CLAIMS. The Arbitration shall be administered by the American Arbitration Association (“AAA”), 120 Broadway, Floor 21, New York, NY 10271 (AAA), or JAMS, 1881 Von Karman Ave., Suite 350 Irvine, CA 92612 (JAMS). Arbitration shall be administered according to the arbitration service’s commercial arbitration fee schedule and the service’s current commercial rules and procedures except that: 1) the parties expressly waive the applicability of any rule governing class, collective or mass action; and 2) the parties agree that any specific arbitration procedure provided for herein shall apply to the arbitration proceeding. The arbitrator shall be neutral and independent and shall comply with the selected arbitration service’s code of ethics. Additionally, the arbitrator shall be guided by and apply the Federal Rules of Evidence and “governing substantive” law. The arbitrator’s award shall be final and binding on all parties, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards. Judgment on the arbitration award may be entered in any court having jurisdiction over the parties. If a party fails to comply with the arbitrator’s award, the other party may petition a court having jurisdiction to enforce the award.

Notwithstanding the above, YOU MAY CHOOSE TO PURSUE A FUTURE CLAIM IN COURT AND NOT BY ARBITRATION IF YOU OPT OUT OF THESE ARBITRATION PROCEDURES WITHIN 45 DAYS FROM THE DATE OF VISITING THIS SITE OR ACCEPTING ITS OFFERS. You may opt out of these arbitration procedures by calling (844) 311-6211 or via the internet by completing the opt-out form at Westgate Opt-Out Form. Any opt-out received after the opt-out deadline will not be valid and you must pursue your claim in arbitration. Whether you accept this arbitration agreement or opt out of arbitration so you can proceed in court, you acknowledge and agree that, in any court case you may file, you WAIVE THE RIGHT TO A TRIAL BY JURY AND THAT YOU CANNOT FILE A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE OR MASS ACTION OR PARTICIPATE IN A CLASS ACTION.

Sponsor reserves the right to change these terms and conditions without notice. These terms and conditions are final and cannot be changed or altered by any statement, merchant, or representative of any unauthorized person(s). No other representations, oral or otherwise, are valid in conjunction with this Giveaway.
