Eligibility

The Westgate Resorts $5,000.00 Gift Card Sweepstakes (the "Sweepstakes") is open only to those who register at the Westgate booth by entering their information and completing all required fields on the form. Must be twenty-eight (28) years of age or older as of the date of entry to be eligible to win. The Sweepstakes is only open to legal residents of the United States and is void where prohibited by law. Employees of Westgate Resorts, Ltd. (the “Sponsor”), Central Florida Investments, Inc., or its respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each, are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or where not registered. This Giveaway does not discriminate against anyone based on race, sex, age, handicap, religion, national origin, or marital status.

Agreement to Rules

By participating in the Giveaway, you agree to be fully and unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Sponsor as final and binding as it relates to the content. You agree to hold Central Florida Investments, Inc., Westgate Resorts, LTD, and their related or affiliated companies harmless and hereby release and indemnify their agents and employees from any and all liability that may arise from providing your Contact Information or accessing any affiliated sites.

How to Enter

The Giveaway must be entered between Friday, September 1st, 2023 (09/01/2023) starting at 1:00 p.m. EST until Tuesday, December 31st, 2024 (12/31/2024) before 3:00 p.m. EST. Entrants may enter via QR code posted at events or via tablets provided at giveaway booths set up at specialized events during the Giveaway period. Simply enter your personal information in all required fields of the registration form. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You must complete the requested information to qualify to win. You may not use multiple email addresses, accounts, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Sponsor.

Prize and Prize Conditions

One (1) winner will receive a prize of five thousand dollars ($5,000.00) in digital gift cards in increments of two hundred and fifty dollars ($250) for major national stores: retailers, restaurants, entertainment, supermarkets, department stores, or pharmacies. The average retail value is $5,000.00. Prize details shall be determined solely by the Sponsor. The prize code must be redeemed by July 8th, 2025 (07/08/2025). You must follow the redemption instructions provided by the Sponsor. No substitution of prize for cash or any other concept is permitted, except at the sole discretion of the Sponsor. The prize is non-transferable. It cannot be combined with any other offer, promotion, or package. If a prize (or portion of a prize) is unavailable, the Sponsor, at its discretion, reserves the right to substitute the original prize (or that portion of the prize) with an alternative prize of the equal monetary value and/or specification, unless to do so would be prohibited by law. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. The winner is responsible for all incidentals, service charges, gratuities, personal expenses, and transportation. Any and all entrants participating in or use profanity, unsportsmanlike conduct, explicit or discriminatory language, and/or defamation of the Westgate brand or any of the other participants will be automatically disqualified at the sole and absolute discretion of the Sponsor. The Sponsor shall not be responsible for any lost, garbled, incomplete, and/or corrupted entries, and qualified entries shall be determined in Sponsor’s sole and absolute discretion. Acceptance of the prize constitutes permission for the Sponsor to use the winner's name, likeness, photograph, statements, biographical information, voice, and address in all forms of media worldwide, in perpetuity, without limitation, notice, or further compensation.

Winner Selection and Notification

The winner of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor to be held on January 8th, 2025 (01/08/2025) at 5601 Windhover Drive Orlando, FL 32819. Winners will be notified via telephone call and email at the number and address provided at the time of entry following winner selection. The Sponsor shall have no liability for a winner's failure to receive notices due to lack of account notifications, spam filters, junk email, or other security settings by the winners, or for the winners' provision of incorrect or non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within seven (7) calendar days from the time the prize notification was sent, and/or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate winner may be selected at the sole and absolute discretion of the Sponsor. The winner's receipt of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Terms and Conditions

The prize cannot be redeemed for cash or other services. The prize cannot be used in conjunction with any other offer, promotion, and/or certificate. Dates for certificate use are subject to availability as determined by the Sponsor at its sole and absolute discretion. All participants must be twenty-eight (28) years of age or older and a U.S. resident to win. The Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, virus, or other technical problem corrupts the administration, security, or proper development of the Sweepstakes, as determined by the Sponsor at its sole and absolute discretion. The Sponsor also reserves the right to remove all participants who have tampered with the entry process or the operation of the Sweepstakes or who have acted in violation of these rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these rules shall not constitute a waiver of that provision. Void where prohibited by law or where not registered. The Sponsor shall not be responsible for any lost, garbled, incomplete, or corrupted entries, and qualified entries shall be determined solely at the Sponsor's discretion. The Sponsor reserves the right to modify the terms, requirements, prizes, and rules of the Sweepstakes at its sole discretion. The prize code must be redeemed by July 8th, 2025 (07/08/2025).

Release and Limitations of Liability

The winner agrees to release and hold harmless the Sponsor, its related and affiliated entities, and their respective officers, directors, employees, members, affiliates, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or any claim arising out of and against all losses, damages, liabilities, claims, actions, proceedings, or judgments arising out of or relating to the participant's entry or participation or the use or misuse of the prizes. All participants agree to release and forever hold harmless the Sponsor, its related and affiliated entities, and their respective officers, directors, employees, members, affiliates, and agents from and against any claim or cause of action arising out of any technical or human error that may occur in the processing of submissions in the Sweepstakes. By participating in this Sweepstakes, the participant agrees that the Sponsor shall not be liable for any actual or potential losses, including without limitation compensatory or consequential damages, whether in contract or tort, whether to persons or property, arising out of or in connection with this Sweepstakes or due to misrepresentation by a third party. The Sponsor shall not be responsible for any acts of God or any other circumstances beyond its control.

Disputes

This offer is void where prohibited by law. All federal, state, and local laws and regulations apply. Except where prohibited, all issues concerning the construction, validity, interpretation, and enforceability of these official rules, or the rights and obligations of participants, winners, and Westgate in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the State of Florida. Any and all disputes arising directly or indirectly out of or in connection with this Sweepstakes shall be brought exclusively before the State or Federal Court of Orange County, FL. The present Sweepstakes is intended to be viewed and participated in at the time of entry and shall be construed and evaluated solely in accordance with the laws of the United States. Offers are not directed to residents of any state and do not constitute an offer where registration of a time-share plan is required but where registration requirements have not yet been met.

You acknowledge and agree that, in any legal proceeding you may file, YOU WAIVE THE RIGHT TO A JURY TRIAL AND THAT YOU MAY NOT BRING A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE, OR MASS ACTION, OR PARTICIPATE IN A CLASS ACTION LAWSUIT.
